Privacy Agreement General Information

Charitable Foundation "Magic Wings" (hereinafter referred to as the magwings.org), understanding the importance of ensuring the confidentiality and inviolability of Personal Data of individuals, concludes this Privacy Agreement (hereinafter referred to as the "Agreement") with you (hereinafter referred to as the "Agreement") to determine the procedure for obtaining, storing, processing , use and disclosure of the User's Personal Data by the magwings.org when the User of the magwings.org uses the opportunities to attract and render charitable assistance through: https://magwings.org (hereinafter referred to as the "Website ").

To use the Website and its capabilities, the User must accept the terms and condtions of this Agreement. The User does not have the right to use the Website and its opportunities to attract and render charitable assistance provided by the Website (hereinafter referred to as the Opportunities), in case of disagreement with the terms and conditions of this Agreement. The Users of the Website agree that in order to comply with the requirements of the Law of Ukraine "On the Protection of Personal Data" and to comply with the Rules, Principles and Procedures, the magwings.org (https://magwings.org/privacy) has the right to include personal data provided by users in the personal data base, on the processing of such personal data and, if necessary, caused by the fulfilment of the conditions of this law, the transfer of such personal data to third parties.

Timing

Personal data - information about a certain User, which allows to identify this User as an individual.

Public data is information (including Personal data), to which an individual – the owner of these data – has provided access to an unlimited number of persons (including by publishing on any website without restricting access to this data) or to which, in accordance with this Agreement and/or the current legislation of Ukraine, the confidentiality requirement does not apply.

Account is a set of information about the User, containing the User's authorization data (login and password) necessary to identify the User when using the Website and Services.

Cookie is a piece of data created by the Website and stored on the User's computer in the form of one or more files. Cookies do not contain personal data and can be blocked by the User at any time.

1. Subject of the Agreement

1.1. This Agreement determines the procedure for obtaining, storing, processing, using and disclosing Personal, Public and other data provided to the Website by the User when using the Website and Opportunities.

1.2. Using any part of the Website and Opportunities, the User grants the Website the right to receive, store, process, use and disclose the User's Personal Data under the terms and Conditions of this Agreement.

1.3. This Agreement does not regulate, and the magwings.org is not responsible for the procedure for obtaining, storing, processing, using and disclosing the User's Personal Data by third-party enterprises and organisations that are not owned or operated by the magwings.org, and individuals who are not employees of the magwings.org, even if the User accessed the websites, software, goods or services of these persons using the Website.

1.4. The purpose of obtaining, storing, processing and using the User's Personal, Public and other data is to protect the interests of the User and the Website, as well as providing the User with Opportunities, including displaying targeted, personalized or general information, improving the quality of existing and creating new websites and opportunities provided by the Website.

2. Receipt, processing and use of information

2.1. When creating an account, the User must provide authorization data, as well as given name, last surname, public name, email address and other data. After the creation and use of the Account by the User, the magwings.org is able to identify the User each time he/she uses the Website.

2.2. The magwings.org has the right to download Cookies to Users' computers (if the User has not independently restricted this possibility in his/her web browser), as well as to receive, store, process and use the information contained in Cookies.

2.3. When the User uses the Website and the Opportunities of the equipment on which the Website is located, the Website automatically stores, processes and uses the User's data that are not personal, for example: the User's IP address, geolocation, i.e. data about the User's location, which can be determined using his/her IP-addresses, UTM parameters, technical parameters of the User's computer, the presence or absence of specific software on the User's computer, settings of these software, cookies, as well as statistical information about the User's activity.

2.4. The magwings.org has the right to store Personal, Public and other data of the User in the amount and within the time period necessary to achieve the purpose specified in this Agreement, or within the time limits established by the current legislation of Ukraine, international law, or the legislation of the country of residence or stay of the User, or by the time of data deletion by the User.

2.5. In the event of a change in Personal Data, the User must provide the magwings.org with updated data by making appropriate changes to the Account on the Website. If the User fails to comply with this requirement, the magwings.org shall not be liable for the adverse consequences associated with the processing of such Personal Data.

3. Access to information

3.1. The magwings.org undertakes not to provide personal data to third parties for commercial purposes without the consent of the User who owns this data. The transfer of Personal Data to third parties for the implementation of the statutory activities of the magwings.org and the fulfilment of our obligations under concluded transactions is allowed in the following cases: – after obtaining the consent of the User who owns this information; – if it is necessary to transfer personal data in order to fulfil obligations and carry out the statutory activities of the magwings.org or at the User's request; – at reasonable requests of governmental bodies that have the right to receive such data; – in the event that, in the opinion of the magwings.org, the User violates the terms of this Agreement and/or other contracts and agreements between the magwings.org and the User.

3.2. The User allows the magwings.org to grant permission to other companies with which the magwings.org has entered into relevant agreements to receive, store and process data about the User (other than Personal Data), such as the User's IP address, Cookies, as well as statistical information about the User's activity to improve the quality of services and information of an advertising nature provided by these companies.

3.3. The User agrees that the confidentiality of the data transmitted via the Internet is not guaranteed, and if access to this data is obtained by third parties outside the area of technical means of communication within the control of magwings.org, the magwings.org is not responsible for the damage caused by such access.

3.4. The User has the right to request, change or delete his/her personal data available to the magwings.org. To do this, the User must submit a corresponding request by sending it to the contact address of the magwings.org in the [email protected], if another independent method of requesting, changing or deleting Personal Data is not provided for by the technical capabilities of the magwings.org. In the subject line of the letter, you must indicate "Deletion/change of personal data", and in the body your contact details and user ID on the website platform. If your request was not satisfied within 30 days, you can file a complaint with the regulatory body viz. the Commissioner of the Verkhovna Rada of Ukraine for Human Rights by e-mail: [email protected]

3.5. Some Opportunities of the magwings.org are aimed at creating and administering charitable donations for financial support of Users’ projects and partner charitable and public organisations – Operators of Assistance to the magwings.org. The magwings.org has the right to publish information about the User's contribution to such projects on the Website, in particular, the last name and first name (or name) of the User, the signature for the contribution and the amount of the contribution. In case of refusal, the User has the right to hide the surname and given name (or name) in his/her/its contribution, using the option provided by the Website.

3.6. Some services of the Website provide for making and/or receiving payments in favour of Users' charitable projects using third-party payment systems that are not subordinate to the magwings.org and have their own terms of use and privacy policy.

4. Additional terms

4.1. The magwings.org has the right to make changes to this Privacy Agreement. All changes made to the Agreement will be available in the form of a new version of the Agreement, at: https://magwings.org/privacy and in case of significant changes to the Agreement, the magwings.org will additionally notify the User about these changes by e-mail specified in the User Account. All changes to the Agreement come into force from the moment of their publication. By using the Opportunities or the Website, the User confirms his/her consent to the new terms and conditions of the Agreement as amended, valid at the time the User uses the Opportunities and/or the Website.

4.2. The magwings.org is not responsible for damages or losses incurred by the User or third parties as a result of an erroneous understanding or misunderstanding of the terms and conditions of this Agreement, instructions or recommendations on how to use the Website, on the procedure for placing data and other technical issues. Prior to accepting the terms and conditions of this Agreement, any User has the right to refer to the magwings.org for clarification regarding the provisions of the Agreement.

4.3. If any part of this Agreement is declared invalid or unfulfilled, the other parts of the Agreement shall remain in effect. Any waiver by either party of any term or condition of this Agreement, or any breach thereof, shall not void that term or condition.

4.4. The laws of Ukraine apply to this Agreement and the relationship between the Website and the User arising in connection with the use of the Website. Each party irrevocably agrees that the respective courts of Ukraine shall have exclusive jurisdiction over claims, disputes or controversies relating to the Agreement and use of the Website.

5. Your rights In accordance with the Law of Ukraine "On the Protection of Personal Data" you have the right to:

– know about the sources of collection, the location of their personal data, the purpose of their processing, the location or place of residence (location) of the owner or manager of personal data or give an appropriate instruction to obtain this information to persons authorized by him/her, except in cases established by law; – receive information about the conditions for granting access to personal data, in particular information about third parties to whom your personal data are transferred;

– access to your personal data;

– receive an answer on whether your personal data is being processed, as well as receive the content of such personal data no later than in thirty calendar days from the date of receipt of the request, except as otherwise provided by law;

– present a reasoned demand to the owner of personal data with an objection to the processing of your personal data;

– present a reasoned demand to change or destroy their personal data by any owner and manager of personal data, if these data are processed illegally or are unreliable;

– protect your personal data from illegal processing and accidental loss, destruction and damage due to deliberate concealment, failure to provide or untimely provision of them, as well as to protect against the provision of information that is unreliable or discredits the honour, dignity and business reputation of an individual;

– file complaints about the processing of your personal data with the Commissioner of the Verkhovna Rada of Ukraine for Human Rights or the court as specified in this Agreement;

– apply legal remedies in case of violation of the legislation on the protection of personal data;

– make reservations regarding the restriction of the right to process your personal data when giving consent;

– withdraw consent to the processing of personal data;

– know the mechanism of automatic processing of personal data;

– defense of an automated decision that has legal consequences for you.

If you are in staying the EU, in accordance with the GDPR you have the right to:

– request access to your personal data that we store, their deletion or correction;

– be informed about what processing of your personal data is made;

– restrict the processing of your personal data;

– the portability of your personal data;

– object to the processing of your personal data;

– file a complaint with the relevant supervisory authority.
